With the changes in family law over the last 30 times, including the relinquishment of indifferent distribution in place of the old common-law rules, the relinquishment of laws guarding military consorts, and the relinquishment of support guidelines and colorful original rules announced within the colorful circuits, the area of separation and divorce has come much too complicated and technical for someone who doesn't regularly handle these types of cases. It torments us when guests come to us with inadequately drafted separation agreements, and/ or rulings that other inexperienced attorneys have handled. Just as it's better to win at trial than to have a great appeal issue, it's much better to have the right attorney, one who'll get it right the first time, than to have to pay someone to fix problems stemming from crimes made in the first place. occasionally the crimes are veritably expensive and can not be fixed as shown in the series of papers I wrote for The Family Law News, a peer review publication of the Virginia State Bar, Section of Family Law, entitled" expensive crimes in Multi-State Military Divorce Or a Military woman's Tale of Woe," which are published in the Fall 2007 and Spring 2008 issues of the publication.
The series of papers outlines the legal authorities, strategy, and procedural points we used to successfully defend a military retiree, who was a stage of the Vietnam War. His wife was trying to gain half of his military sheltered pay and conjugal support than in Virginia, despite having disassociated him six times before in Hawaii. While we're always happy to achieve a successful outgrowth for our guests, we felt sorry for the wife, who had entered poor legal advice from hr attorney in the original divorce action in Hawaii, advice that lead to poor opinions which the Virginia Court set up to bind her permanently. In ruling for us in the case, the judge told the wife that rather than suing her ex-husband, the show should go after the attorney in Hawaii who represented her in the divorce.
So, how do you go about changing a good divorce counsel? They are many suggestions
Ask a Lawyer
Still, ask him or her for a referral to a good divorce counsel, If you know a council. He or she'll presumably know someone or several someones who devote a significant portion of the practice of law to separation and divorce and affiliated issues. For illustration, I've been handling separation and divorce 30 times and have an excellent character in the original legal community. Any divorce attorney worth his/ her swab should have established a character among other attorneys. attorneys generally know who's good for a particular type of case; they know who they would see if they were facing separation and divorce.
Yellow Pages/ Internet
While not a great source of information, the Yellow runners and the internet can be a morning source of attorney names. attorneys who don't mention separation, divorce, military divorce, and related areas like guardianship and support or property division, aren't seeking cases in those areas and do not devote a significant portion of the practice to those areas. Be leery of advertisements that include a laundry list of everything under the sun. Flashback to the old byword," a jack of all trades and master of none"? Wouldn't you rather have someone who takes the time to concentrate at least a significant quantum of time on family law, than someone who perhaps devotes 3 of his/ her practice to family law issues? Flashback not everyone advertises in the Yellow runners or has a website or internet presence. For illustration, there are more telephone rosters than there are attorney advertisements in the Yellow runners.
VIRGINIA counsel REFERRAL SERVICE
The Virginia Lawyer Referral Service is operated by the Virginia State Bar. attorneys must ask to get on the list and must agree to a fixed figure for an original discussion. A council can be listed under any order he or she asks for. The names are on a rotating list and given to consumers who communicate the service. Again, not all attorneys are listed. We aren't listed with the referral service. This resource can give the name of an attorney who's seeking family law cases. This doesn't mean that the attorney is an expert in these types of cases or that he or she is educated. All it means is that he or she's seeking divorce cases. Be sure to take the questions I talk about then to the attorney interview.
