Sections 29A, 29B, and 29C of the 1993 Building Act (the Act) outline the requirements for house demolition in Geelong .
What happens when you need planning permission for a demolition of a building?
A building surveyor determines whether demolition is allowed under section 24 of Act. If a building plan calls to issue a permit for demolition, the responsible authority must deny the application. Obtaining a building permit without consent would be considered a violation of section 24.
Section 24 deals with situations when planning permission is required, but not obtained, for a proposal to demolish a structure. After obtaining planning permission, the applicant should withdraw their application for a building permit.
This will help applicants save time and money as they don't have to wait for or pay for reports.
A demolition permit has been granted to an individual. In such cases, the responsible authority should approve the application.
What information do I need to include when applying for Report or Consent from a Responsible Authority?
Request for consent and a recommendation form should accompany the recommendation form.
How long does it take for authorities to give consent?
According to Regulation 34, the consent or report must arrive within 15 days. This period does not begin on the date the request was received.
What happens to the responsible authority if they fail to respond within 15 days?
Geelong house-moving experts say that the Act allows a building inspector to make a decision without the need for a report from the responsible authorities. However, in such cases the reporting agency is deemed to have disapproved.
If the responsible authority does not respond within the specified time frame, it is crucial to determine whether planning permission is required in order to demolish the building. RBS will determine whether to grant the request based on the consent granted by the reporting authorities.
